We will do our best to

I,
the undersigned, renting Unit B 301 at Sapphire Beach Resort & Marina, St. Thomas , U.S.V.I. for
vacation or recreation purposes, agree to the following.
I
am responsible for full payment for the entire rental period: ½ the rent plus ½
the damage deposit being due with the return of this Agreement to secure my
reservation. The balance of the rent plus damage deposit being due, and
an 10% Room Tax is due 30 days prior to arrival. Payments must be made by
check ,or money order. Reservation is not confirmed until the Rental
Agreement has been returned and the deposit cleared.
Failure
to make payments when due will result in cancellation of this Agreement.
I,
as the responsible party, am at least 21 years of age.
If I cancel the reservation after
it has been confirmed, the Owner will make every attempt to re-book my
reservation. If the reservation is re-booked at the same rate, I will be
refunded 90% of the Total funds paid. If the reservation cannot be
rebooked I understand that the payment(s) paid may not be returned.
I agree
to accept the rental property upon arrival, provided it meets the basic
description as listed on the rental websites.

I,
my guests and visitors agree that there will be no loud or large parties in the
apartment or on the premise. That all listed previously will maintain the
premises in good order and appearance and conduct themselves in a manner
inoffensive to the neighbors.
I,
my guests and visitors agree to lock all doors and sliders while the unit is
unoccupied.
I,
my guests and visitors, agree that any drug use on the property, or any
disturbance, annoyance, endangerment, or inconvenience of the neighbors; or use
the premises for any immoral or unlawful purposes, or violation of any law or
ordnance on or about the premises will immediately terminate our occupancy and
rental agreement of these premises.
Owner
or owner’s agent may enter the premises immediately in the event of an
emergency, in order to perform necessary repairs and/or maintenance.
Occupancy
(including small children and infants) is not to exceed 6 persons. If more than
the maximum number or the number stated in the contract is found to be
occupying the leased property, I agree that a charge of $100.00 per person per
day will be made to my credit card, or if I am paying by check or money order,
I will promptly submit payment due. Additionally, this agreement may be
immediately terminated without refund.
No
pets are allowed on the premises. Violation will result in immediate
eviction.
I
will be responsible for all damage, breakage and /or loss to the premises,
except normal wear and tear and unavoidable casualties (deemed by the Managers
of Property) which may result from occupancy. I agree that all pipes, wires,
glass, plumbing, household contents, etc., other equipment and fixtures will be
in the same condition as at the beginning of our stay, except in cases of
unavoidable fire and natural disaster damage.
The
property will be left in good and habitable condition. Any damages or
notable conditions found upon arrival will be reported to the Property Managers
within one (1) hour of occupancy. I understand the property will be
inspected prior to my occupancy and when I depart.
I
acknowledge any loss and/or damage to the property will result in a charge for
replacement value to my credit card, or if I am paying by check or money order,
I will promptly submit the payment due. I agree to indemnify and hold
Owner and Property Managers harmless from all liability, loss or damage arising
from any nuisance or harm made or suffered on the leased premises by myself, my
guests or invitees. I also hold the Owner and Property Managers free from
liability caused by any carelessness, neglect, or improper conduct of any
persons entering, occupying or visiting the apartment or premises during my
occupancy.
The
Owner shall provide utilities, furniture, fixtures, bathroom and kitchen
supplies. Housekeeping services are not included but must be purchased for
a charge of $65 as dictated in your quote.
Extra cleanings can also be purchased once on sight.
Prior
to vacating the property tenant is responsible to ensure all dishes and
cookware are cleaned and put away, and return any furniture that was moved to
its original position. Beds may be left unmade and sheets and pillowcases
left on. Used towels may be left on the floor. Return the keys to
the check out counter. Ensure the sliding doors are closed and locked
when you leave.
Owner
shall not be liable to Tenant, Tenant’s guests or invitees or any other person for
any injury, loss or damage to any person or property on or about the
premises. Tenant shall hold Owner and Managers harmless and indemnified
from and against all loss, injury or damage occasioned by the use, misuse or
abuse of any part of the premises, parking lot, beach or community and from or
against any omission, neglect, or default of Tenant, guests or invitees.
A
safe is provided for guest use. The Owners will not be liable or
responsible for personal items left behind, lost or stolen. If an item is
left after checking out and the Tenant wishes to have it returned, notify the
Owners as soon as possible. The Owners will attempt to arrange
shipment. Tenant will be informed of the shipping cost and, with
approval, the charge will be deducted it from the damage deposit to cover the
expense.
Should
there be a failure in the systems providing air conditioning, hot water or
electrical power; guest should contact the front desk of the resort @
(340)776-6100, ext. 0.

This
Agreement may not be assigned or the property sublet, and is for the Tenant’s
use only.
